Gerard Fox Law Wins Two More Trials

One of the nation’s top trial attorneys and founder of Gerard Fox Law, Gerry Fox, and the firm’s two trial teams won two jury trials this week!

On August 29, 2017, Partner Wealth Management, LLC (“PWM”), represented by one of the firm’s New York trial teams, won a significant evidentiary hearing in Connecticut Superior Court (Stamford).  The case involved an Audubon hearing to summarily enforce an email exchange between the parties that the plaintiff alleged was really a settlement agreement.  PWM was adamant that no such agreement had been reached.  After a full evidentiary hearing over two days, the Court determined that the parties never intended for the email exchange to constitute a binding and enforceable agreement.  This favorable judgment protected PWM from being bound by a writing that would have resulted in severe adverse tax consequences and which failed to include any of the standard settlement provisions such as confidentiality and non-disparagement clauses.

On the same day, one of our Los Angeles trial teams gained a victory in the Los Angeles Superior Court. The firm represented a renowned legal staffing agency, Gregg Ziskind & Associates, against a large company based in Los Angeles on a breach of contract claim. The Los Angeles Superior Court jury returned with a verdict after less than a day following the six-day bifurcated trial in favor of Gregg Ziskind & Associates for the entirety of the contract claim submitted to the jury.

With these two victories Gerry Fox’s undefeated record remains intact. Mr. Fox’s jury trial record is now 39-0 and his record in trial overall is 40-0.

These victories come only a few weeks after Lauren Greene, one of the firm’s senior associates, won a unanimous verdict in the Los Angeles Superior Court.
