Marco J. Martemucci joined Gerard Fox Law with more than seven years of experience guiding clients through litigation and government investigations and advising on intellectual property matters. His primary focus is on copyright and trademark litigation and brand protection counseling. Mr. Martemucci also has experience with internal investigations, securities litigation, patent litigation, complex commercial disputes, and defamation defense.
In his intellectual property practice, Mr. Martemucci assists media and entertainment companies and artists on copyright matters, both pursuing and defending infringement claims, defending clients in SAG arbitrations, and counseling clients on developments in new media and technology. He works with the owners of well-known luxury brands in trademark, trade dress, and copyright litigation and licensing disputes involving apparel, cosmetics, and jewelry. He also assists clients in selecting, clearing, and registering trademarks, protecting trade secrets and defending against patent infringement claims. Mr. Martemucci has extensive experience in the area of brand protection and enforcement, assisting clients to develop strategies to combat counterfeit and grey market goods by regularly coordinating with prosecutors, law enforcement and private investigators regarding illicit trade investigations. In connection with this work, Mr. Martemucci has significant experience in matters involving American Indian law—specifically, sovereign immunity and taxation issues—as it relates to brand protection, unfair competition, and counterfeiting of products sold on reservations.
Mr. Martemucci also advises clients on internal investigations, shareholder litigation demands, accounting, audits, fraud, insider trading, market manipulation, and securities trading practices. He defends institutions and individuals in securities-related investigations and enforcement proceedings conducted by the US Securities and Exchange Commission and the US Department of Justice. Mr. Martemucci also has significant experience defending corporate clients facing False Claims Act investigations, and using California’s anti-SLAPP statute to defend clients accused of defamation.
Mr. Martemucci maintains an active pro bono practice in which he assists not-for-profit organizations protect their intellectual property rights and defend against a variety of litigation threats. He also works on immigration-related matters, having helped prepare the American Bar Association’s expansive report on immigration reform and drafted an amicus brief in the US Court of Appeals for the Ninth Circuit in support of an ACLU challenge to immigration detention policies. Recently, Mr. Martemucci was extensively involved in the successful federal court trial to enjoin Wisconsin’s restrictive voter identification law.
Prior to private practice, Mr. Martemucci served as a law clerk to US District Judge Jed S. Rakoff, in his capacity as the Chairman of the Grievance Committee for the US District Court, Southern District of New York, handling all attorney discipline matters for the court.
