Michael Murphy graduated from the University of California, Berkeley School of Law (“Boalt Hall”) in 2000 where he was honored with the Student Service Award. He received his bachelor’s degree from Oberlin College, having double-majored in Biology as well as Law & Society. After graduating from law school, Mr. Murphy served as a law clerk to the Honorable Ronald Lee Gilman, of the United States Court of Appeals for the Sixth Circuit.
Mr. Murphy joined the litigation boutique of David M. Bass & Associates, Inc. in 2007. Together, Mr. Murphy, David Bass, and his other colleagues at David Bass & Associates spent a decade litigating on behalf of a wide variety of clients in diverse industries, both as plaintiffs and defendants. Mr. Murphy is experienced in state and federal court (trial courts and courts of appeal), as well as practicing before administrative agencies and in arbitration. Mr. Murphy’s successful experience includes not only favorable jury verdicts, arbitration awards, appeals, and summary judgment rulings, but, also vigorously using (and understanding) all available litigation and appellate procedures to achieve maximum leverage, allowing his clients to obtain the most beneficial business result. Mr. Murphy believes that achieving his client’s preferred results requires a combination of a love of the law and practice of law, a zealous dedication to his client’s needs and interests, and his belief in the value of teamwork.
Mr. Murphy has extensive experience in litigation and matters involving corporate governance disputes, breaches of fiduciary duty, fraud, defamation, the anti-SLAPP statute, trademark and trade dress litigation, trade secrets, real estate litigation, among others. Mr. Murphy also has experience counseling clients on various types of contract negotiations, including Operating Agreements, asset purchase agreements, and management contracts. He also has experience prosecuting trademark applications before the United States Patent and Trademark Office, as well as the Trademark, Trials, and Appeal Board (TTAB).
The industries in which Mr. Murphy has experience are as diverse as they are numerous and include real estate development, venture capital, the gaming industry (including gaming regulation), the apparel industry, software development, market research, printing, food and beverage, international music licensing, nursing homes, franchises, nursing homes and long term care facilities, the semiconductor industry, as well as startup ventures in an also diverse array.
Mr. Murphy has a deep commitment to his community, which involves extensive participation in non-profit governance, fundraising, and consulting. Mr. Murphy currently sits on two non-profit boards, including his eight-year service as Board President of Being Alive, Los Angeles, a non-profit providing psychological care and other wellness services to people with HIV living below the poverty line.
